Litigation and Arbitration
We represent our clients in proceedings before common courts, administrative courts and arbitration courts in all cases related to intellectual property rights.
In proceedings before common courts we represent our clients in cases concerning infringements of industrial property rights, copyrights and combating unfair competition. Our actions include both the pre-litigation stage and court proceedings as well as subsequent enforcement proceedings:
- preparing cease and desist letters
- negotiating and drafting settlement agreements
- drafting and filing preliminary injunction requests and representing clients in preliminary injunction proceedings
- drafting and filing statements of claims and statements of defense, and representing clients in proceedings before the civil courts of every instance
- drafting and filing complaints, appeals and cassation complaints
- enforcing judicial decisions and representing clients in enforcement proceedings
- providing assistance in the enforcement in Poland of judgements issued by foreign courts
In proceedings before administrative courts we represent our clients in cases where final decisions were issued by the Polish Patent Office in application proceedings and/or opposition, invalidation and cancellation proceedings:
- submitting complaints against decisions of the Polish Patent Office and responses to complaints
- submitting cassation complaints against judgments of the Regional Administrative Court of Warsaw and responses to complaints
- representing clients in proceedings before the Regional Administrative Court of Warsaw and the Supreme Administrative Court
In proceedings before specialized arbitration courts we represent our clients in cases concerning Internet domain names:
- submitting information concerning an Internet domain name dispute and obtaining an Arbitration Clause.
- drafting statements of claims and representing clients in proceedings before, inter alia, the Court of Arbitration in Matters Concerning Internet Domain Names at the Polish Chamber of Information Technology and Telecommunications
- enforcing arbitration awards
